The unanswered questions posed by Labour’s plan for a new Ethics and Integrity Commission

Labour’s manifesto proposes a new independent Ethics and Integrity Commission to oversee and enforce ethical standards in government, but offers no real detail on the remit and powers of this new body, or how it will fit into the wider standards landscape. Peter Riddell outlines some of the difficulties in designing the new Commission and argues that it is crucial that the country’s constitutional watchdogs are both independent of government and accountable to parliament.  

The familiar landscape of standards in public life could be about to change. The Labour manifesto proposes to ‘establish a new independent Ethics and Integrity Commission (EIC), with its own independent chair, to ensure probity in government’. This is a major part of its aim ‘to restore confidence in government and ensure ministers are held to the highest standards’. The pressures for changes in the standards regime have only been increased by the latest scandal over allegations of insider betting by mainly Conservative candidates and party officials on the election date. 

Yet while the direction of change is clear, there is still considerable uncertainty about how the new EIC will work, what its powers and remit will be, what its relations will be both with the main constitutional watchdogs and, in particular, with the Committee on Standards in Public Life (CSPL). There is a need for much greater clarity if the new arrangements are to work. Labour has also made separate proposals on the powers of some of the regulators. 

There are all kinds of models for an EIC. Public comments by Shadow Cabinet member Nick Thomas-Symonds before the election indicate that Labour has rejected a super-regulator combining some or all of the current constitutional watchdogs, which anyway perform very different functions. This points to an umbrella organisation, which would be headed by a new independent chair. It is important for public credibility and accountability that this new chair is chosen as a result of an open public competition which could be held in the late summer or early autumn after the role and remit of the EIC have become clearer.

Constitutional watchdogs: restoring the role

Unit research shows that the public cares deeply about ethics and integrity in public life. Many constitutional and ethical watchdogs exist: there is a consensus that they need strengthening, but not on how, or to what extent. Robert Hazell and Peter Riddell have produced a new report on how to reinvigorate these watchdogs: they summarise their conclusions here.

This week we have published a new report, Trust in Public Life: Restoring the Role of Constitutional Watchdogs. It comes at an important juncture, when public trust in politicians has fallen to an all-time low. There is a wealth of evidence from survey data about the decline in trust; not least from the Constitution Unit’s own surveys, as part of our Democracy in the UK after Brexit project. Those surveys show that the public value honesty in politicians above qualities like being clever, working hard or getting things done; but only 6% of the public believe that politicians who fail to act with integrity are dealt with effectively. There is an urgent need to repair and rebuild the system for upholding standards in public life if trust in politicians is to be restored.

Constitutional watchdogs are the guardians of the system for upholding standards. The Unit has long had an interest in them, from one of our earliest reports in 1997 to one of our most recent, on parliament’s watchdogs published in 2022. This new report is complementary to the one on parliament, in studying the watchdogs which regulate the conduct of the executive. They are the Advisory Committee on Business Appointments (ACOBA); the Civil Service Commission; the Commissioner for Public Appointments (OCPA); the Committee on Standards in Public Life (CSPL); the House of Lords Appointments Commission (HOLAC); the Independent Adviser on Ministers’ Interests; and the Registrar for Consultant Lobbyists.

A series of official and non-governmental reports have all agreed that these watchdogs need strengthening; but there is less agreement on how, or by how much. That is the gap that our report is intended to fill. It sets out a range of strengthening measures, in detail, for implementation early in the next parliament. Early action is possible because most of our recommendations do not require legislation.

The civil service: what is its role?

Recent years have seen significant tensions between ministers and civil servants, with allegations of bullying by ministers and leaking by civil servants, and a number of permanent secretaries forced out. This has prompted debate about reform. Lisa James, Meg Russell, and Alan Renwick argue that any changes to the form and functions of the civil service should have at their heart the core civil service principles of integrity, honesty, objectivity and impartiality.

Background

The civil service is a vital part of the UK’s constitutional system, and is central to helping the government of the day to develop and implement policy. Nonetheless, there are perennial tensions and questions about its role, which have heightened in recent years. The volume and tenor of recent attacks by some politicians on the civil service have provoked particular concern.

This briefing explains the role of the UK civil service, and how it works with ministers. Some civil servants have frontline delivery roles – for example, jobcentre workers, border officials and prison officers. But the briefing focuses on those civil servants who work in central government departments, particularly those working with and around ministers on policy.

What is the role of the civil service?

The UK civil service is permanent and politically impartial. Civil servants continue in post when governments change, and are forbidden from offering political advice to ministers – a role performed instead by special advisers. They must also maintain individual impartiality (which precludes, for example, senior civil servants engaging in party political activities even outside their work).

However, the civil service is not independent. Its fundamental role is to serve actively the government of the day in policy development and delivery. This does not simply mean following ministers’ instructions: good governance requires ministers to draw on a range of objective, evidence-based advice and balanced perspectives before making decisions. Hence civil servants provide such advice on the pros and cons of policy options – even if that sometimes contains unwelcome messages. Civil servants also translate policy decisions into action, implementing the policy direction set by ministers.

Standards in public life: are we in a post-Nolan age?

In 1995, the Nolan report established ‘Seven Principles of Public Life’. Twenty-five years later, questions have been raised about the continuing relevance of the Nolan principles. Lord (Jonathan) Evans of Weardale, Chair of the Committee on Standards in Public Life, argues here that although we are not not yet living in a ‘post-Nolan’ age, there are reasons for real concern.

In recent months we’ve heard a new phrase used by academics, commentators, and members of the public who have an interest in public standards. That phrase is a ‘post-Nolan age’. 

The sentiment is encapsulated in an email sent to my Committee’s mailbox earlier this year. A member of the public told us they ‘feel a great sadness that the moral framework which has guided British public life for the past quarter century appears to be well and truly over’.

The email referred to the growing perception that those in public life no longer feel obliged to follow the Nolan principles of selflessness, integrity, objectivity, accountability, openness, honesty and leadership – otherwise known as the Seven Principles of Public Life

These principles have long underpinned the spirit of public service in this country, and were first formally articulated in Lord Nolan’s seminal 1995 report – the first from the Committee on Standards in Public Life, of which I am now Chair.

Since 1995 it has been increasingly accepted that anyone in public service should act in accordance with the Seven Principles. The Principles apply to ministers and MPs, all civil servants, local government officials, public bodies, the NHS, agencies as well as private companies and charities delivering services on behalf of the taxpayer. The Principles are not a rulebook but a guide to institutional administration and personal conduct, and are given a hard edge when they inform law, policy, procedure and codes of conduct. 

In their essence, the Seven Principles are there to govern the legitimate use of entrusted power in public life. All of us in public life, whether through democratic election or public appointment, have some degree of power afforded to us on the public’s behalf, whether it is the power to make decisions on benefits, to spend money on schools, to legislate to protect public health or to influence debate. This power is lent to us to be used for the good of the public.
